Messages on Herhost are encrypted at rest. However, Herhost is not an end-to-end encrypted platform. The Company retains the ability to access message content for the following limited purposes:
By using the Platform's messaging system, you acknowledge and consent to this limited access. The Company will never sell, share, or use message content for advertising or marketing purposes.
Herhost provides voluntary personal safety tools including check-in systems, emergency contact notification, and panic alert features. These tools are provided as a courtesy for personal safety purposes only. They are not connected to any Platform transactions or bookings. The Company makes no warranty regarding the reliability or effectiveness of these safety tools and shall not be liable for any failure of these systems. Creators are encouraged to maintain independent safety plans and trusted support networks.
Herhost uses a token system for fan transactions. Token purchases are processed by CCBill, a third-party payment processor. By purchasing tokens you agree to CCBill's terms of service. All token purchases are final and non-refundable except as required by applicable law. The Company reserves the right to forfeit token balances associated with accounts terminated for violations of these Terms. Creator earnings are paid out at a 70% revenue share after platform fees. The Company's 30% platform fee covers payment processing, platform maintenance, safety infrastructure, and operational costs.
Herhost has a zero-tolerance policy for child sexual abuse material (CSAM). All uploaded content is subject to automated scanning. Any account found to have uploaded CSAM will be immediately terminated, all content preserved, and the matter reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement authorities as required by 18 U.S.C. 2258A. The Company cooperates fully with law enforcement in all CSAM investigations.
In compliance with the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA-SESTA), 18 U.S.C. 2421A, Herhost expressly prohibits the use of this Platform to promote or facilitate prostitution or sex trafficking. Any content, message, or activity determined to violate FOSTA-SESTA will result in immediate account termination and reporting to federal law enforcement. The Company actively monitors the Platform for such violations and cooperates fully with federal, state, and local law enforcement.
Creators retain full ownership of all content they upload to the Platform. By uploading content, creators grant Herhost a limited, non-exclusive license to display, distribute, and promote that content within the Platform for the purpose of operating the service. This license terminates upon account deletion. Herhost does not claim ownership of creator content and will not use creator content outside the Platform without explicit written consent.
The Company reserves the right to suspend or terminate any account at any time for violation of these Terms. Upon termination for cause, all token balances and pending earnings may be forfeited. Creators terminated for CSAM, FOSTA-SESTA violations, or trafficking will be reported to law enforcement and permanently banned. Creators terminated without cause will receive any earned but unpaid revenue owed at the time of termination.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. The Company's total liability for any claim shall not exceed the greater of $100 or the amount you paid to the Company in the three months preceding the claim.
These Terms shall be governed by the laws of the State of [STATE], without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved by binding arbitration in [CITY, STATE], except that either party may seek injunctive relief in any court of competent jurisdiction.
